DEFINITIONS
"Moitribe" (also referred hereinafter as “We”, “Us” or “Our”) refers to the web and app-based
HTML 5 gaming platform operated and owned by Veniso Solutions Private Limited and its sister
company Obigin Media Labs LLP, based out of Hyderabad, Telangana, India and including its
website, mobile applications, and associated services.
"User" (also referred hereinafter as “You”or “Your”) refers to any individual or entity accessing or
using the Moitribe platform, including registered users, guests, and visitors.
"Platform" refers collectively to the Moitribe website, mobile applications, games, interactive
features, and other services provided by Moitribe.
"Content" refers to any games, text, images, videos, audio, graphics, software, code, or other
materials available on the Moitribe platform, including user-generated content.
“Premium Games” refer to special games available on the Moitribe platform that users can access
after payment using virtual currency (Coins) from their Wallets.
“Play & Win Games” refers to the interactive games available on the Moitribe platform where users
can participate to win virtual rewards such as Diamonds and Coins.
“Tournaments” or “Events” refer to competitions hosted on the Moitribe platform where users can
compete to earn Diamonds.
“Coins” refer to virtual currency used within the Moitribe platform to play Premium Games or
participate in Tournaments.
“Diamonds” refer to virtual currency earned by users through gameplay, competitions, or specific
achievements on the Moitribe platform.
“Wallet” refer to the virtual store on the Moitribe platform where users' Diamond and Coin balances
are stored, and transactions are processed.
“Rewards Zone” refer to a section of the Moitribe platform where users can redeem Diamonds for
rewards, vouchers, or prizes.
“Fair Play” refers to the adherence to rules and guidelines established by Moitribe for all games and
competitions, ensuring a level playing field for all users.
"Terms and Conditions" refers to this legal document governing the use of the Moitribe platform by
users.
"Privacy Policy" refers to the document outlining Moitribe's practices regarding the collection, use,
and protection of user data and personal information.
"Third-Party Services" refers to any services, products, or content provided by third-party providers
that may be accessed or integrated with the Moitribe platform.

"Intellectual Property" refers to copyrights, trademarks, patents, trade secrets, and other proprietary
rights owned or licensed by Moitribe, including but not limited to the platform, games, software,
designs, logos, and branding.
"User Account" refers to a personal account created by a user to access and use the features and
services offered by Moitribe, including but not limited to gameplay, social interactions, and
personalized settings.
"Dispute Resolution" refers to the process by which conflicts, claims, or disputes arising between
Moitribe and users are resolved, including arbitration, mediation, or other alternative dispute
resolution methods.
"Effective Date" refers to the date on which these Terms and Conditions come into effect, as
specified at the beginning of the document.
"Modification" refers to any changes, updates, or revisions made to these Terms and Conditions by
Moitribe, as described in the document.
"Indemnify" refers to the obligation of a user to compensate, defend, and hold harmless Moitribe
from any claims, losses, damages, liabilities, or expenses incurred as a result of the user's actions or
violations of these Terms and Conditions.
"Termination" refers to the cessation or closure of a user account or the discontinuation of access to
the Moitribe platform, as described in the document.
"Arbitration Institution" refers to the organization or body responsible for overseeing arbitration
proceedings, as specified in the Dispute Resolution section of these Terms and Conditions.
"Jurisdiction" refers to the legal jurisdiction or governing law applicable to these Terms and
Conditions, as specified in the document.
"User-Generated Content" refers to any content, including text, images, videos, or other materials,
created or submitted by users on the Moitribe platform.
"Third-Party Payment Gateway" refers to the external payment processing service used by Moitribe
to facilitate financial transactions, as described in the Billing and Payment section of these Terms and
Conditions.
"Force Majeure" refers to unforeseeable circumstances or events beyond the control of Moitribe,
including but not limited to natural disasters, acts of war, terrorism, government actions, or technical
failures.
"Affiliates" refers to any subsidiaries, parent companies, partners, or other entities related to Moitribe
by ownership, control, or common corporate interests.

GENERAL TERMS AND CONDITIONS FOR USER
These Terms and Conditions ("Terms") govern your use of Moitribe's online platform, including
interactive games, social networking features, and related content (collectively referred to as the
"Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not
agree with these Terms, you should not use or access the Services.
1. Acceptance of Terms
a. The use of the Services is available only to persons who can form legally binding
contracts under applicable law. Persons who are incompetent to contract within the
meaning of the law are not eligible to use the Services. Without prejudice to the
generality of the above, no person under the age of 18 may use or access the
Services or the Games or attempt to enter into any transactions on our website.

Continued use of the Moitribe platform after the posting of changes constitutes acceptance of
those changes. If users do not agree with the updated Terms, they should discontinue using
the platform.
3. Privacy and Communications
a. Any information submitted through the Service, including personally identifiable
information, is subject to the terms of our Privacy Policy.
b. By using or accessing the Service, you consent to the use of electronic
communications in order to enter into contracts and confirm terms from Moitribe. You
also acknowledge that you have access to the necessary software and hardware to
receive electronic records from Moitribe.
4. Ownership of Intellectual Property
Moitribe, its affiliates, and its licensors/licensees retain all title, rights, and interests in the
Services and the Games, including all intellectual property rights.
5. Limited License
Moitribe grants you a temporary, non-exclusive, non-transferable, conditional, limited right to
access, interact, and play the Games for your personal, non-commercial use, subject to
certain conditions.
6. Use of the Service
Access to the Games is provided on an "as is" basis by Moitribe. Users are responsible for
evaluating content and interactions. Moitribe disclaims all warranties in relation to the
Services and the Games.
7. Membership and Features
a. Some features of the Services are available only to registered members. Users must
provide accurate information when creating an account.
b. There may be different types of registration and membership available on the Moitribe
platform, including both free and paid options. Users opting for paid memberships

may gain access to additional features, content, or services beyond those available to
free members.
c. Moitribe reserves the right to change, supplement, alter, or remove any of its features
or Games as it deems fit. This includes modifications to features and content
available to different categories of registration and membership. Moitribe may
introduce new features, update existing ones, or discontinue certain features or
Games based on the user's membership tier or subscription plan. Any changes to
features or Games will be communicated to users in accordance with the terms
outlined in these Terms and Conditions.
8. Billing and Payment
Moitribe uses a different types of third-party payment gateway including but not limited to
Telecom Billing, Credit or Debit Card, Internet Banking, Voucher Codes, Wallet Billing etc. to
process payments. Users must agree to the terms of the payment gateway service provider.
The third-party payment gateway service provider will require certain financial information
including your credit card /debit card or other banking information. Other than providing a
confirmation upon receipt of payment against a membership account, disclaims any and all
liabilities in relation to your payment processing by such third-party payment gateway service
provider and the collection and processing of any information provided to party payment
gateway service provider. While using such payment gateways to make payments to, you will
be required to accept the terms of use and privacy policies of such payment gateway service
provider. We request you to please make yourself familiar with the terms of use and privacy
policies of your respective payment gateway service provider before using such service.
9. Disclaimers of Warranties and Limitations on Liability
a. The Services of Moitribe are provided "as is" and "as available" with all faults and
without warranty of any kind. Moitribe assumes no responsibility for certain damages.
b. Moitribe does not guarantee the accuracy, currency, completeness, or reliability of
any advice, opinions, statements, products, or services advertised through the
Service Services. Moitribe does not warrant that the Services or Games will meet
your requirements or be uninterrupted, secure, or free from errors, viruses, or other
security intrusions.
c. Moitribe does not endorse or warrant the accuracy or completeness of any
statements, representations, advice, views, or opinions contained in Games or
advertisements. The licensors of such content are solely responsible for its accuracy
and completeness.
d. Access to the services and games is subject to users having the necessary hardware,
software, and network resources as listed in the system requirements. Users are
responsible for any costs incurred while accessing our services or games, including
payments towards internet and broadband access or any additional expenses
incurred. Users are responsible for any damages to their computer system such
personal computer, mobile phones or tablets etc. or loss of data resulting from
accessing or downloading Games, data, or software through the Service.
e. Moitribe disclaims any liability for damages suffered by you, including loss of data,
due to delays, errors, system downtime, mis-deliveries, or service interruptions.We do
not guarantee the confidentiality of information transmitted through the Service
Services.
f. Due to the interactive nature of our services, users may inadvertently create
unintended images, messages, or representations using game mechanics,
characters, images, sounds, visualizations, or other content. Any opinions, advice,
statements, services, offers, or other information expressed or made available by
third parties through our services are solely those of the respective authors or

producers and not of Moitribe, its shareholders, directors, officers, employees, or
licensors. Moitribe, along with its shareholders, directors, officers, employees, or
licensors, shall not be liable for any loss or damage caused by your reliance on
information obtained through our services. It is User’s responsibility to evaluate the
information, opinions, advice, or other content available through our services.
g. Moitribe does not warrant that the games will function in accordance with their rules
or that objectives within the games can always be completed as intended. Moitribe
disclaims all warranties related to its services and games. Additionally, Moitribe does
not guarantee error-free access to our services or games, as their quality may be
contingent on various factors outside Moitribe’s control, including the network
resources used by users.
h. All images, videos, and presentations used to promote the games are merely
representative, and we do not guarantee that users will be able to experience or
perform such content/actions within the games.
i. Moitribe does not make representations regarding the legality of our services under
the applicable law of users' jurisdictions. Users are advised to access our services
only if permitted under their jurisdiction's laws. By using and accessing our services,
users represent that they are permitted by the applicable laws of their jurisdiction to
do so.
j. Third Party Links: The Service may provide links to websites operated by other
entities. Your use of these sites is at your own risk, and we do not endorse or
warranty the information, products, or services provided on linked sites.
k. From time to time, various aspects of the service may be tested including website,
user interfaces, service levels, plans, promotions, features, availability of content,
delivery, and pricing, and Moitribe reserves the right to include or exclude users from
these tests without notice.
10. Indemnity
You i.e. Users undertake to indemnify, defend and hold harmless Moitribe, its affiliates, and
its licensors from any loss, damage, or claim arising from or related to any breach of these
Terms.
11. Governing Law and Severability
a. These Terms shall be primarily governed by and construed in accordance with the
laws of the jurisdiction from where the service is delivered, except where there is a
conflict with the laws of India. In the event of such conflict, the laws of India shall
prevail.
b. If any part of these Terms is held illegal or unenforceable, such provision shall be
deemed separable from the remaining parts of these Terms and shall not affect the
validity or enforceability of the remaining provisions. Moitribe reserves the right to
interpret and enforce these Terms in accordance with the laws of India in case of any
ambiguity or conflict.
12. User Conduct
Users of Moitribe's gaming platform are expected to adhere to certain standards of conduct to
ensure a positive and safe experience for everyone. By accessing or using our platform,
users agree to:
Not transmit any unlawful, harassing, libellous, tortious, abusive, offensive,
threatening, or obscene content, or infringe on any third party’s rights.
Refrain from using abusive language, engaging in harassment, or bullying other
users.

Abide by the rules and guidelines established for each game, including refraining
from cheating, hacking, or exploiting bugs to gain an unfair advantage.
Avoid engaging in unauthorized commercial activities, advertising, or solicitation on
the platform.
Comply with all community guidelines and game rules established by Moitribe,
including those related to fair play, respectful behavior, and appropriate content.
Moitribe reserves the right to take appropriate action, including suspending or
terminating user accounts, in cases of violation of these conduct standards.
13. Interactive Areas of Service
As a User of the Moitribe platform, you are permitted to post reviews of Games, compare
scores, and participate in multiplayer games through our services. However, please note that
Moitribe does not provide any warranties regarding your online experience or interaction with
other users during multiplayer games. We do not regularly select or review the content posted
on or interactions made through our website or services; nevertheless, we reserve the right to
reject, remove, or edit such content at any time without prior notice.
Using Moitribe service, you understand and agree that we may, but are not obligated to,
review the content and may delete or remove it (without notice) in our sole and absolute
discretion, for any reason or no reason.
14. User Account Creation
a. When creating your account, it is imperative that you provide accurate and complete
information. Maintaining the confidentiality of your account and password is your
responsibility, and you must take measures to restrict access to your device
designated for using Moitribe service.
b. Sharing your password or account with others holds you accountable for their actions,
and you may be liable to compensate The Service for any resulting losses. Under no
circumstances should you utilize another user’s membership account without explicit
permission.
c. In the event of a security breach or unauthorized use of your account, you must notify
us immediately. It is also recommended to report such instances to your card issuers
and local law enforcement agency.
d. To facilitate convenient access to your account and assist in administering our
service, we utilize technology to recognize you as the account holder. This allows for
direct access to your account without requiring you to re-enter your password or other
user identification during subsequent visits.
e. You are responsible for ensuring the truth and accuracy of the information provided to
us regarding your account, and it is essential to keep this information updated.
15. User-Generated Content
a. Moitribe's platform may allow users to create, upload, and share content, including
text, images, videos, and other materials. By submitting content to the platform, users
grant Moitribe a worldwide, non-exclusive, royalty-free license to use, modify,
reproduce, adapt, publish, translate, and distribute the content in any form and on any
media.
b. Users understand and agree that Moitribe may, but is not obligated to, monitor,
review, or moderate user-generated content. Moitribe reserves the right to remove or
refuse to display any content that violates these Terms and Conditions or is deemed
inappropriate, offensive, or illegal.

c. Users acknowledge that they are solely responsible for the content they submit to the
platform and agree to indemnify and hold Moitribe harmless from any claims arising
from their content.
16. Account Suspension or Termination
Moitribe reserves the right to suspend or terminate user accounts, without prior notice, for any
reason or no reason, including but not limited to:
Violation of these Terms and Conditions or any other policies or guidelines provided
by Moitribe.
Fraudulent activity or unauthorized use of the platform.
Inactivity or breach of community guidelines.
Users may appeal the suspension or termination of their accounts by contacting Moitribe's
support team. However, Moitribe retains sole discretion in deciding whether to reinstate
suspended or terminated accounts.
17. Advertisements
Certain features and functionalities of the Moitribe platform may be supported by advertising
revenue.
Display of Advertisements: Moitribe reserves the right to display advertisements
and promotions within its services, which may be targeted based on stored
information, user queries, or other data.
Changes and Disclaimers: The manner, mode, and extent of advertising may
change without specific notice. Moitribe does not take responsibility for third-party
advertisements, or the products/services offered by advertisers.
User Responsibility: Any interactions or transactions with advertisers are solely
between the user and the advertiser, and Moitribe shall not be liable for any losses or
claims arising from such dealings.
18. Promotional Offers
Moitribe may periodically offer additional features or discounted access to its users as
promotional offers, either free of cost or at discounted rates.
As-Is Basis: These promotional offers are provided on an "as is" basis without any
warranty or obligation, unless expressly stated otherwise.
No Obligation: The availability of promotional offers does not imply any obligation on
Moitribe's part to continue offering such offers in the future.

19. Intellectual Property Infringement
Moitribe respects the intellectual property rights of others and expects its users to do the
same. If you believe that your copyright or trademark rights have been infringed upon on the
Moitribe platform, please submit a written notice to Moitribe's designated email id or contact
details provided on the webiste, including:
Identification of the copyrighted work or trademark claimed to have been infringed.
Sufficient information to locate the allegedly infringing material on the platform.
Your contact information, including name, address, phone number, and email
address.
A statement that you have a good faith belief that the use of the material is not
authorized by the copyright or trademark owner, its agent, or the law.
A statement, under penalty of perjury, that the information provided in the notice is
accurate and that you are the copyright or trademark owner or authorized to act on
behalf of the owner.
Moitribe will investigate and respond to all properly submitted infringement claims in
accordance with applicable laws and regulations.

20. Dispute Resolution
Any disputes or claims arising out of or relating to these Terms and Conditions or the use of
Moitribe's platform shall be governed by the laws of India without regard to its conflict of law
provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or
the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with
the rules of Arbitration under laws of India, and judgment upon the award rendered by the
arbitrator(s) may be entered in any court having jurisdiction thereof.
21. Limitation of Liability
Moitribe, its affiliates, directors, officers, employees, agents, and licensors shall not be liable
for any direct, indirect, incidental, special, consequential, or exemplary damages, including
but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses
arising out of or in connection with the use or inability to use the Moitribe platform.
In no event shall Moitribe be liable for any direct, indirect, special, or consequential damages
related to the use of the Service Services, even if advised of the possibility of such damages.
This allocation of risk is considered reasonable by the parties involved.

TERMS AND CONDITIONS FOR TOURNAMENTS & REWARDS
These Terms and Conditions ("Terms") govern your use of Moitribe's online platform and its
competition, gratifications section called as Tournaments or Events and/or Rewards Zone, including
interactive games, social networking features, and related content (collectively referred to as the
"Services").
The General Terms and Conditions outlined in Section General Terms and Conditions for User are
hereby incorporated by reference into these Terms and Conditions for Tournaments & Rewards.
By participating in any tournament or event on Moitribe's platform, users agree to abide by both the
General Terms and Conditions and the specific terms outlined in this Terms and Conditions for
Tournaments & Rewards section.
1. In the event of any inconsistency or conflict between the General Terms and Conditions and
the Terms and Conditions for Tournaments & Rewards, the provisions of the Terms and
Conditions for Tournaments & Rewards shall prevail to the extent necessary to resolve such
inconsistency or conflict.
2. Users acknowledge that the General Terms and Conditions govern their overall use of
Moitribe platform, including but not limited to gameplay, account management, and
interactions within the community, while the Terms and Conditions for Tournaments &
Rewards apply specifically to their participation in tournaments and events.
3. By continuing to use Moitribe's platform and participating in tournaments or events, users
confirm their understanding and agreement to both the General Terms and Conditions and
the Terms and Conditions for Tournaments & Rewards. By accessing or using the Services,
you agree to be bound by these Terms. If you do not agree with these Terms, you should not
use or access the Services.
4. You must be of legal age or have parental consent to use the Services provided by Moitribe.
By using the Services, you represent and warrant that you meet these eligibility criteria.
5. You may use the Services for personal, non-commercial purposes only. Any unauthorized
use of the Services, including but not limited to hacking, reverse engineering, or distribution of
content, is strictly prohibited.
6. To access certain features of the Services, you may be required to create an account. You
agree to provide accurate and complete information during the registration process and to
keep your account credentials secure.
7. Participation in premium games and tournaments may require the expenditure of virtual
currency that are called Coins. Moitribe reserves the right to define the terms and conditions
for playing these games, including the allocation of Coins for any game, service, tournaments
and/or events etc.
8. Moitribe reserves the right to update or revise these Terms at any time without prior notice.
Continued use of the Services after such changes constitutes acceptance of the modified
Terms.
9. Use of Coins:
Coins are virtual currency utilized within the Moitribe platform for accessing premium games,
tournaments, or other features as determined by Moitribe.
a. Users may spend Coins to participate in premium games, tournaments, or other
activities offered by Moitribe, subject to the terms and conditions outlined within the
platform.

b. The number of Coins required to participate in premium games or tournaments is
determined solely by Moitribe and may vary based on game rules, tournament entry
fees, or other factors.
c. Moitribe reserves the right to adjust the cost of participation using Coins, in premium
games or tournaments or events or competition, as well as the associated rewards, at
any time without prior notice. This includes the ability to modify costs and rewards
during ongoing campaigns aimed at enhancing competitiveness, improving user
experience, or introducing new features. Such adjustments may be made to maintain
a fair and balanced gaming environment and to respond to changing market
dynamics.
d. Users acknowledge that Coins have no monetary value outside of the Moitribe
platform and cannot be exchanged for cash or other forms of currency.
e. Moitribe is not liable for any loss, theft, or misuse of Coins by users and shall not be
held responsible for any disputes arising from Coin transactions between users.
f. Users agree to use Coins only for authorized purposes within the Moitribe platform
and in compliance with the terms and conditions set forth by Moitribe.
g. Moitribe may impose limits on the maximum number of Coins that can be spent within
a certain time-period or on specific activities, as deemed necessary to maintain fair
and equitable access to the platform.
h. Users understand that the spending and utilization of Coins may be subject to
additional terms and conditions specified within the Moitribe platform, and it is their
responsibility to review and adhere to such terms.
10. Use of Diamonds:
Diamonds are virtual currency awarded to users for various achievements, including but not
limited to winning games, tournaments, or competitions organized by Moitribe.
a. The allocation of Diamonds is at the sole discretion of Moitribe and may vary
depending on the specific game or tournament rules.
b. Users acknowledge that Diamonds have no cash value and cannot be redeemed for
currency or monetary compensation outside of the Moitribe platform.
c. Moitribe reserves the right to modify the allocation and distribution of Diamonds, as
well as the terms and conditions for earning and using Diamonds, at any time without
prior notice. This includes the ability to adjust the cost of participation in premium
games or tournaments, as well as the associated rewards, during ongoing campaigns
aimed at boosting competitiveness, enhancing user engagement, or introducing new
features. Such modifications may be implemented to ensure a fair and dynamic
gaming environment, respond to user feedback, or align with market trends.
d. Users agree to use Diamonds only within the Moitribe platform and for purposes
outlined within the Services provided by Moitribe.
e. Moitribe disclaims any liability for the loss, theft, or unauthorized use of Diamonds by
users and shall not be held responsible for any disputes arising from Diamond
transactions between users.
f. Users understand that the accumulation and usage of Diamonds may be subject to
additional terms and conditions outlined in the Moitribe platform, and it is their
responsibility to review and comply with such terms.

11. Use of Wallet & Wallet System:
The Wallet system within the Moitribe platform serves as a virtual store where users' virtual
currency, including Coins and Diamonds, are stored and managed.
a. Upon registration with Moitribe, each user is provided with a Wallet, which
automatically records and updates the balance of virtual currency earned or
purchased by the user.
b. Users acknowledge that the Wallet balance reflects the total amount of virtual
currency available for use within the Moitribe platform and does not represent real-
world monetary value.
c. The Wallet and its associated virtual currency are not connected to any banking
system or financial institution. Therefore, users understand and accept that the Wallet
cannot be used for financial transactions, including but not limited to deposits,
withdrawals, or currency conversions.
d. Users further acknowledge that the virtual currency stored in the Wallet cannot be
redeemed for any form of real-world currency. Moitribe shall not be responsible for
any misunderstanding or misinterpretation regarding the nature of the Wallet and its
virtual currency. Users are solely responsible for understanding and abiding by the
terms and conditions governing the use of the Wallet within the Moitribe platform. Any
attempt to use the Wallet or its associated virtual currency for financial transactions or
purposes outside the Moitribe platform is strictly prohibited and may result in the
immediate suspension or termination of the user's account.
e. By using the Service, users expressly agree to waive any claims or rights to convert
virtual currency into real-world currency or to treat the Wallet as a financial instrument
or asset.
f. Moitribe reserves the right to adjust the Wallet system, including but not limited to the
allocation, earning, spending, and redemption of virtual currency, at its sole discretion
and without prior notice.
g. Moitribe reserves the right to modify, suspend, or terminate the Wallet system or its
associated virtual currency at any time, with or without prior notice, at its sole
discretion.
h. Users are responsible for maintaining the security and confidentiality of their Wallet
credentials, including passwords or any other authentication mechanisms used to
access the Wallet.
i. Any unauthorized access, use, or manipulation of a user's Wallet, including but not
limited to unauthorized transactions or transfers of virtual currency, shall be the sole
